General conditions of use of Yui Marus

1. User (hereinafter, Users) is any natural or legal person who registers in Yui Marus.

4. Yui Marus only allows the registration of Users over 18 who have the necessary legal capacity to register on our Website. In the event that the User registration does not meet the above requirements, Yui Marus reserves the right to cancel the account.

In those cases in which behaviors are detected where our conditions, policies, norms may have been violated, regardless of the nature (punctual or repeated), or in the event of suspicion of activities that could be considered illegal or illicit, we will be forced to take measures aimed at solving these situations. As a consequence of these acts, we could suspend or disable the account / s from which these actions are carried out. There will be cases in which we will be forced to act by legal imperative, such as, at the request of the Justice, State Security Bodies, complaints, repeated infringement of intellectual property rights, etc. In any case, we will establish communication channels with those affected to inform them or offer them options to correct these behaviors.

16. In no case, the existence of linked sites, names or brands of third parties must presuppose the existence of agreements with those responsible or owners thereof, or the recommendation, promotion or identification of the Owner with the statements, content or services provided by these.

23. Yui Marus has established the Euro as the base currency of her Website.

24. In general, the contents offered by Yui Marus on its Website are non-refundable. If a User cancels their subscription, it will remain active until the end of the period for which they were billed. From that moment on, all payment functions will not be available.

25. Citizens of the European Union can request a refund for the entire amount during the 14 days after the start of the subscription. This starts at the time of subscription, therefore, if the subscription is made during the one-month free trial period, the term begins on the first day of the free trial; Therefore, after the test, no fee will be returned as a refund. 26. The Parties expressly submit, in the event that discrepancies arise in relation to these Conditions or our policies, to the decision made by Yui Marus, and, in the event that the decision is not satisfactory for any of the parties and is had to resort to judicial resolution, the Parties renounce their own jurisdiction, where appropriate, submitting to the Courts and Tribunals of Madrid capital (Spain).

27. The full text of these conditions, as well as the documents derived from them, including Annexes, have been written in Spanish. Yui Marus may provide Users with translations into other languages, however, in case of discrepancy, the Spanish version will prevail over the others.

Particular conditions of the mentoring / coaching process

​

To all those Users who start a memory / coachingle process, the following clauses will apply, in addition to the "General Conditions of Use of Yui Marus":

1. The mentoring / coaching program of Yui Marus (hereinafter, the Program) establishes a relationship between Mentors / Coaches (Senpai) and Mentees / Coachees (Kohai) (hereinafter, the Participants), in which both recognize and accept comply with these conditions.

2. Participants expressly declare that they have read and accept the following conditions of service before making any type of registration on the Yui Marus Website. When the registration in the Program is formalized, the Participants accept and remain bound to them.

3. The Program is the commitment between two or more people to accompany, share, knowledge, ideas, experiences, or experiences and thereby contribute to the personal and professional growth of Kohai.

4. The Senpaiso mentors / coaches of our Program are people with extensive experience, experience and knowledge who wish to accompany, help mentor their Kohais. The Senpaises' mission is to help the Kohais achieve their goals. They will be able to offer any type of information or help that helps the Kohais and to carry out these tasks, they must use the different tools that Yui Marus puts at their disposal.

5. Kohaiso mentees / coachees are people who want to set new goals for their personal development or that of their professional career and who wish to be guided on this path by one or more Senpais.

6. The Program will start when both parties (Senpai and Kohai) mutually agree to the request to start the program.

7. Once the Program has started, the Participants agree to these obligations that will remain in effect for the duration of the aforementioned Program and will subsist once it is finished.

8. Participating in the Program implies the commitment of active cooperation between the Participants, and participation in all the evaluation processes of the Program (periodic or final).

9. Participants agree to use exclusively the collaborative tools provided or proposed by Yui Marus throughout the development of the Program.

10. Participants are responsible and must guarantee the truthfulness and accuracy of the data provided in Yui Marus. Likewise, this responsibility will extend beyond the end of the Program.

11. It is recommended that the Programs have a minimum duration of 6 months and a maximum of 12, in those cases where it is necessary to shorten or extend these durations, it must be agreed upon by the parties.

12. Early cancellations of the Programs, by the Participants, must be adequately justified by the applicant and communicated 15 days in advance to the other participant. 

13. Participants, in no case, may use the Program as a means of advice, of any nature or for the establishment of a commercial or contractual relationship between them. Failure to comply with this clause will be considered a serious offense.

14. For the purposes of the provisions of these conditions, CONFIDENTIAL INFORMATION is understood to be all numerical, alphabetic, graphic, photographic, acoustic information, of identified or identifiable natural persons or of any other type, susceptible of collection, registered, processed, transmitted or provided by the Parties directly or indirectly, regardless of the medium on which it is collected or processed.

15. It will be considered NON-CONFIDENTIAL INFORMATION, and therefore neither party will have the obligation to keep confidential any information that:

i. It was known by the PARTIES free from any obligation to keep it confidential, as evidenced;

ii. Is developed or prepared independently by the PARTIES, free of restrictions or from another source with      right to disclose it;

iii. Whether or not it becomes the public domain, without breach of this agreement by the PARTIES;

iv. It is received from a third party without such disclosure violating or violating an obligation of confidentiality.

v. It must be communicated by law or by judicial or administrative requirement.

16. Participants are solely responsible for the possible non-consensual use that they may make of confidential or non-confidential information.

17. The Participants guarantee that the confidential and non-confidential information that they make available to each other may not be used to carry out activities contrary to the law, morality or public order, in any case, the responsibility inherent to these practices is unique. and exclusively of those who carry them out.

18. Participants undertake to keep all the information received as strictly confidential information, not to disclose it or transfer it to third parties without the prior consent of both parties and not to use this information, for a purpose other than the Program, without the prior consent of both. parts.

19. The reports, documents, actions to be taken, tasks indicated and issued by the Senpais will be optional for the Kohais, who may or may not assume them as if it were a council. Therefore, the Senpais will be exempt from any liability that may arise from these actions within the framework of using the Program. ​
